General Terms and Conditions of Dabuka Travel

Booking one or more travel services of Dabuka Travel is based on the following travel and payment conditions. They apply to both package tours and individual tourist services.
1. Conclusion of the Contract
1.1 By booking (travel registration), you offer Dabuka Travel a binding contract for the requested travel services. Booking can be made in writing, by phone, online, or via travel agents. You usually receive a confirmation from your travel agent about receipt of your registration.
1.2 The contract between you and Dabuka Travel is concluded when you receive the booking confirmation/invoice from Dabuka Travel, either directly or via your travel agent.
2. Essential Characteristics / Service Changes / Side Agreements
2.1 The essential characteristics of the services are based on pre-contractual information, catalog descriptions, website information, and booking confirmations. Descriptions by service providers are not binding.
2.2 Dabuka Travel reserves the right to change essential service features after contract conclusion if necessary and not caused in bad faith. You will be informed immediately in writing.
2.3 For significant changes, you may withdraw without fees or request a comparable alternative.
2.4 Travel agents cannot confirm side agreements unless explicitly confirmed in the booking confirmation.
3. Payment Terms
Payment terms and due dates will be communicated in your booking confirmation. For specific payment conditions regarding the Sun Eclipse 2027 tours, please refer to our Cancellation Policy.
4. Transport Services
Travel times indicated in the booking confirmation are subject to changes.
5. Passport, Visa, and Health Regulations
Travelers are responsible for obtaining necessary documents, vaccinations, and complying with customs regulations. Dabuka Travel is not liable for delayed visa issuance unless it fails its duties.
6. Minimum Number of Participants / Withdrawal
Dabuka Travel may withdraw from the contract if the minimum number of participants is not reached. Paid amounts will be refunded.
7. Replacement Person
Travelers can request that a third party takes their place. Dabuka Travel may charge a processing fee of €50.
8. Rebooking
Rebooking is possible up to 30 days before travel, subject to availability, for a fee of €50 plus any additional costs. Certain travel services, such as flights, cruises, and tickets, may be excluded.
9. Withdrawal Before Departure / Compensation
9.1 You can withdraw anytime before travel. Dabuka Travel may claim reasonable compensation unless extraordinary circumstances apply.
9.2 Compensation is calculated based on the time of withdrawal, expected savings, and alternative use.
9.3 You may prove lower or no damage occurred.
9.4 Non-use of individual services does not exempt full payment.
9.5 Dabuka Travel may claim higher compensation if actual expenses exceed standard rates.

10. Identity of the Operating Airline
Dabuka Travel informs travelers about the airline identity before contract conclusion.
11. Complaints / Remedy / Termination / Limitation Period
11.1 Complaints must be reported immediately to the contact provided.
11.2 Significant service defects allow contract termination if Dabuka Travel fails to remedy within a reasonable period.
11.3 Claims should be made in writing.
11.4 Standard limitation periods apply; compensation claims by Dabuka Travel expire six months after travel ends.
12. Consumer Dispute Resolution
Dabuka Travel does not participate in dispute resolution before a consumer arbitration board.
13. Limitation of Liability
Liability for non-physical damages not caused intentionally or negligently is limited to three times the travel price. International agreements may apply.
14. Liability in International Air Transport
Liability for death, injury, delays, or baggage issues follows the Warsaw or Montreal Conventions.
15. Travel Insurance
Insurance is generally not included. Travel insurance offered is only a brokerage service. Contracts exist solely between you and the insurer.
